The Supreme Court refused to interfere with Patna HC orders granting bail to 56 persons who were arrested and rejected special leave petitions by the Bihar Government.
CJI NV Ramana said, “We do not want to comment on the ..law (Bihar Prohibition and Excise Act, 2016). But the arrests were made in March 2020. they have been in jail for some time before they were granted bail.
“And the appeals were filed in December last year. Much time has elapsed and we would not entertain these appeals.“
The Court recent order together with the one passed on January 11, will release more than 100 persons who were arrested under the prohibition law.
On January 11, the CJI-led Bench had said that the high court had granted bail to over 40 persons and also there has been no complaint against them violating bail conditions.
