A Special Court in Mumbai on the November 10, 2021 allowed actor Rhea Chakraborty to get access to her bank accounts that were frozen by the Narcotics Control Bureau (NCB) on a case against her related to late actor Sushant Singh Rajput’s Death.
Rhea Chakraborty is out on a Bail after being Arrested in 2020 and is going through a trial for Illicit Trafficking and Harboring of Drugs, and for Procuring drugs for Sushant Singh Rajput under Narcotic Drugs and Psychotropic Substances (NDPS) Act,1985 . The NCB previously accused her of being an “Active member of a Drug Syndicate.”
Rhea in her previous Plea regarding the unfreezing of her bank accounts argued that the NCB’s action was unjust and caused prejudice to her.
She also informed the Court that she needs the Bank Accounts to pay her Taxes and support her brother financially.
The Court stated that “From the reply of the officer, it appears that there is no strong objection from the Respondent side for unfreezing the Bank account and FDs (fixed deposits) of the Applicant,” the court said.
The Court also noted that under the present circumstances Chakraborty is “Entitled to unfreezing the bank account and FDs subject to conditions.”
The Court instructed her to give an undertaking in an affidavit stating that during the Proceedings of the trial, “she shall make the balance amount, as shown on September 16, 2020, available for necessary orders.”
Special Public Prosecutor Atul Sarpande, who is representing the NCB, informed the Court that the petitioner’s seized phone and laptop have been returned by the laboratory where the gadgets were sent for Forensic Analysis and that she can collect them from the Investigating Officer.
The Court then separately ordered the NCB to return the aforementioned gadgets after due ‘Verification and Identification,’ and then executed a Bond of ₹1 lakh.
