A father was granted Provisional release for 15 days by the Rajasthan High Court in Jodhpur to perform ‘Kanyadan’ and other rites in his daughter’s wedding.
The current Application for Temporary Release was made on the Grounds that the Appellant’s daughter is being married on April 28, 2022, and the Appellant’s presence is required to conduct the ‘Kanyadan’ and other rites at the wedding.
Acting Chief Justice Manindra Mohan Shrivastava and Justice Madan Gopal Vyas decided in a divided Bench
Taking into consideration the Ground, on which the Temporary Bail is sought, we are inclined to allow the Application to the extent that the Appellant shall be released on Temporary Bail upon furnishing a Personal Bond of Rs.25,000/- along with two local sureties in the like amount to the satisfaction of the Trial Court. The Appellant shall be released on Temporary Bail for a period of 15 days from the date of release.”
The Court ordered that the Appellant surrender before the Trial Court when the 15-day time has expired, and that he be sent to Jail to serve out the remainder of his sentence.
The State’s Public Prosecutor testified before the Court that the basis for the current Temporary Bail Application has been checked, and it has been discovered that the Appellant’s daughter is getting married on April 28, 2022.
