The Punjab & Haryana High Court has affirmed the ejectment of a tenant based on personal necessity and rent arrears, highlighting the landlord’s moral duty to settle his grown-up sons during his lifetime.
Justice Amarjot Bhatti, while considering Balkar Singh’s plea against the Rent Appellate Authority’s ejectment order, emphasized the landlord’s right to start his business and settle his sons.
The case involved an ejectment petition filed by Sucha Singh, the landlord, based on non-payment of rent since January 2000 and the need for the shop for his sons.
The Court rejected Balkar Singh’s argument that the ejectment petition was not maintainable, asserting that he neither owned the shop nor had any right or interest in it.
The Court accepted the Appellate Authority’s finding of a tenant-landlord relationship and noted the arrears of rent.
Justice Bhatti concluded that Sucha Singh’s requirement for the shop was genuine and reasonable, as he intended to construct a departmental store/mall with his sons. The court affirmed the moral duty of the landlord to settle his grown-up sons during his lifetime and deemed the requirement for the tenanted shop bona fide.
The revision petition filed by Balkar Singh was declined by the Court.
