The Himachal Pradesh High Court has ordered the Central Bureau of Investigation (CBI) to take over the Praveen Sharma Death Case.

The Order was passed on 4 December, by the Division Bench consisting of Justice Tarlok Singh Chauhan and Justice Satyen Vaidya based on the Petition filed by a woman requesting CBI Investigation in to the suspicious death of her husband on June 9, 2020.

The Petition stated that her husband was prima facie found in a senseless stated at a concealed place, Kundu Nullah, near Pairvi Pul at Sanaura in Rajgarh Tehsil of Sirmaur, which is not a common thing.

The Petitioner claimed that even though Praveen was brought dead, the Police did not contemplate to register a FIR in the matter. She had also lodged a complaint in written form to SHO with regard to the matter but all the efforts went in vain.

Noting the point of non-registration of the FIR in the Case, the Himachal Pradesh High Court Ordered the Secretary Home to initiate an Inquiry with respect to the role of Police Officials in the Case.

The Court directed for an Inquiry by the Officer not below the rank of Inspector General of Police and that too to be completed before December 31 and the compliance report to be submitted by January 5, 2022.

The High Court has asked to transfer all the records to the Central Bureau of Investigation.

“The police acted as monocratic and unmindful of its Legal obligations. The conduct of the police depicts the sordid, despotic and nepotic functioning of those, who in most brazen, blatant and contemptuous manner, have flouted and defied the mandate of Law. The material on record suggests clearly that the conduct of the police was not bona fide. Police diaries have not been maintained in this case, which further places the conduct of the police in the realm of suspicion,” the Court concluded.
