The bench comprising outgoing Chief Justice of India NV Ramana, Justice Hima Kohli and Justice CT Ravikumar dismissed a petition challenging the dropping of hate speech and other charges against Uttar Pradesh Chief Minister Yogi Adityanath.
The Case: Parvez Parwaz vs. The State of Uttar Pradesh
CM Yogi Adityanath was accused of making anti-Muslim hate remarks while addressing “Hindu Yuva Vahini” activists in a meeting held in Gorakhpur on January 27, 2007.
Advocate Fuzail Ayyubi, appearing for the petitioner, argued that the matter regarding sanction has to go to the Governor as per Supreme Court precedents.
“Nothing was remaining in the matter after forensic and closure reports had been accepted,” Senior Advocate Mukul Rohatgi, appearing for the CM, stated.
Ten people lost their lives as buses, mosques, and homes were burnt down during the riot.
Senior Advocate Mukul Rohatgi, appearing for the state of Uttar Pradesh, stated that the Central Forensic Science Laboratory had stated that the CD in question, which had the alleged hate speech recording, was tampered and fake.
Consequently, the bench has dismissed the plea requesting the dismissal of proceedings.
