The Patiala House Court on February 14, 2022 denied granting any kind of Interim Injunction the Chief Executive Officer of formerly known as ScoopWhoop Media (WhoopScoop), who along with his wife, is allegedly accused of Sexually Harassing one of the employees of ScoopWhoop, Samdish Bhatia.
The Additional Chief Judicial Magistrate of Patiala House Court, Preeti Parewa was hearing a Plea filed by WhoopScoop Media Private Limited, wherein the Plaintiff Company sought an Interim Injunction against Samdish Bhatia and in favor of Sattvik Mishra, who is the CEO of now known as WhoopScoop Media.
The Plaintiff Company in the Plea, sought a restraining order for the current Defendant, Samdish Bhatia, wherein the Defendant will not be allowed to write, post or speak anything about the case and against the Original Defendant (Sattvik Mishra and his wife) and current Plaintiff Company i.e.., WhoopScoop Media and any of the employees of the Company.
In light of this Plea, the Defendant put forth an argument that, “The alleged media reports, screen-shots of videos and social media posts do not, in any manner, name or indicate the name of the plaintiff company.” Furthermore, the Defendant added that, “That, even balance of convenience does not lie in favor of the plaintiff company which is a separate entity and that the complaint of sexual harassment has not been made to the plaintiff company.”
In light of all the arguments and contentions made, the Patiala House Court stated that, “The complaint was not filed before the plaintiff company nor the defendant no.1 was employed with the plaintiff company. Thus, it cannot be said that the plaintiff company has been in any way “injured” with the acts of the defendant no.1.”
Hence, while dismissing the Plea for Injunction, the Additional Chief Judicial Magistrate stated that, “In the opinion of this court, the relief as sought by way of instant application cannot be granted at this stage. Thus, the application at hand is accordingly dismissed.”
