The Bombay High Court on February 11, 2022 passed an Order wherein it summoned a Notary to be present before the Court, regarding the matter where the Notary was found to be working with multiple other Notaries outside the Bombay High Court.
The Bombay High Court Division Bench of Justices S J Kathawalla and M N Jadhav in the Order stated that, “Our attention has been drawn to a Notary named, Shri Shivaji NamdeoDhanage, who has stationed 3-4 cars near the High Court to carry out Notarization of documents. We are informed that Shri Dhanage sits in one vehicle and his clerks sitting in his other vehicles are posing themselves as Notary at different places and Notarizing documents.”
It was later on brought to the High Court’s knowledge that Shivaji Dhanage was not present in Mumbai and therefore he was not able to appear before the High Court on the same day as the Order was passed i.e., February 11, 2022. This information provided by Advocate Raj Shah who recieved this information from Advocate Vijaykumar Dighe.
The Bombay High Court in this regard raised a query pertaining to the time period of Shivaji Dhanage’s stay in Delhi. It was informed by Raj Shah that Dhanage had been in Delhi for 3-4 days and his arrival back in Mumbai was not comfirmed.
The High Court then directly spoke to Advocate Vijaykumar Dighe about Dhanage’s duration of stay in Delhi. It was later on found out that Dhanage had never been to Delhi and that he had been in Chembur area of Mumbai.
In this regard, Advocate Vijaykumar Dighe apologized in front of the Bombay High Court, for unintentionally stating misleading facts in front of the Bench as those facts were provided to him by Shivaji Dhanage himself.
The Bench while Adjourning the matter stated that, “Shri Shivaji Dhanage is therefore, directed to remain present before this Court on 14th February, 2022 at 10.30 a.m. along with his Notary Register. Shri Vijaykumar Dighe who is acquainted with Shri Shivaji Dhanage is informed about this Order and he has assured us that he will convey the same to Shri Shivaji Dhanage.”
