Munawar Faruqui’s bail application order reserved by Madhya Pradesh High Court

The Madhya Pradesh High Court once again reserved orders on bail application of Munawar Faruqui who was arrested by the Indore police on January the 2nd over allegedly hurting of religious sentiments by insulting Hindu gods and goddesses.

Justice Rohit Arya asked what was wrong with his mindset and why he insulted the Hindu gods and goddesses for the sake of his business.

The bench did not seem inclined towards entertaining the bail application whatsoever and asked Senior Advocate Vivek Tankha appearing for Faruqui to withdraw the application if he wanted.

The advocate denied this and submitted that Faruqui has committed no offence and bail should be granted.

A lawyer opposing the petition stated that the comedian has made offensive remarks against Hindu gods and deities and that encouraged other comedians into making such remarks as well.

Justice Rohit Arya rained down heavily on the comedian, saying that such people should not be spared and that the order would be reserved on merits,

He further asked other counsels opposing the application to file their evidence supporting them.

The court had also given the same treatment to Nalin Yadav, co-accused with Faruqui and a co-performer.

Last week the hearing had been dismissed when the police did not produce the case diary, even after the counsel for Faruqui asked the court to ask the police to get the diary during the second half (the police station being very close to the HC).

The complaint was filed on January 2nd along with four others for allegedly making indecent remarks against Hindu figures and Home Minister Amit Shah for a show held on January 1st.

It was filed by RSS and Hindu activist Eklavya Singh Gaur who is also the son of a local BJP legislator under Section 295-A, for hurting religious sentiments and Section 269 for negligent act to spread infection or disease.
