The Supreme Court of Mexico has ruled on September 7, 2021, that criminal penalties on Abortion are unconstitutional.
The ruling by the Top Court has marked a major victory in favour of woman’s rights.
The ruling by the Mexican Supreme Court reflects a stark contrast to increasing restrictions to laws of Abortion in United States.
The Supreme Court took up the matter of a 2018 case, where 8 of 11 Justices voted for revoking a law in State of Coahuila that imposes three-year imprisonment on a woman for having an Abortion, even in the cases of rape.
At the time of final decision making over the issue, all the Justices agreed to revoke the Abortion Law and declared it as unconstitutional.
“Today is a watershed in the history of the rights of all women, especially the most vulnerable,” Supreme Court President Arturo Zaldívar said.
“The vote established mandatory criteria for all Judges in the country, making it no longer possible to prosecute any woman who has an abortion without violating the criteria of the Court and the Constitution,” Arturo Zaldívar added.
The Court has stated that the ruling in Abortion Law will have the retrospective effect, and the women already convicted under the provision of abortion law has the right to appeal their sentences.
