The Madras High Court sentenced a resident of Chennai for three months of jail term for willfully disobeying the Court’s order.
Justice S M Subramaniam of the Madras High Court issued the order in a contempt petition filed against accused D Nagaraja of Saligramam. The High Court judge also ordered the cancellation of a sale deed and construction agreement that were registered in the Velachary Sub Registrar office which was in violation of a court’s order.
The case was in relation to a petition moved to the Madras High Court by U Jinodass and four others who seeking to set aside an award order passed by Lok Adalat in favor Nagarajan.
Previously on 25th June, 2018 the Court passed an interim order instructing the parties involved in the case to maintain status quo until further orders of the Court. In spite, of the interim order passed by the Court Nagarajan registered a sale deed and construction agreement in the Velachary Sub Registrar office for a third party in relation to the property in dispute.
U Jinodass and the other four petitioners found out about the registration of the sale deed and construction agreement, thus they moved to the Madras High Court, for action against Nagarajan for the Contempt of Court.Even though many opportunities were given for him to cancel the sale deed , yet he paid no heed.
Hence Madras High Court in this matter stated, “This court is of the considered opinion that the conduct of the Nagarajan throughout the proceedings establishes that he has no respect towards the proceedings of the court and the law.”
