High Court of Madhya Pradesh denied bail to a man accused of abetment to suicide of a minor girl.
The man is alleged to constantly harassing the minor girl. He kidnapped her and was forcing the minor girl to marry him resulting in which the girl committed suicide.
The charges framed against the man was under Section 305 IPC along with Section 7 and 8 of the POCSO Act.

The accused claimed bail by stating that the aforesaid Act does not involve ingredients that are needed in abetment as contained under Section 107 of IPC and, therefore, he cannot be held liable for abetment of suicide of the minor girl.
With admissibility of shreds of evidence proving that the man used to harass the minor girl regularly, the Court relying on the relevant precedents on this subject held that harassment in the case was “not a stray incident but was a feature in- continum. Thus, prima-facie, the elements of abetment of suicide are found to be existing in this case.”
The Court dismissed the petition and denied granting bail to the accused.
