On Monday, a Lucknow court mandated the filing of a First Information Report (FIR) against online retailer Flipkart for allegedly selling an advocate fake Apple AirPods.
After accepting a complaint from a lawyer located in the city, that the online retailer sold him fake or counterfeit Apple AirPods, the Lucknow Court ordered the registration of a First Information Report (FIR) against Flipkart Officials on Monday.
This ruling was made by Chief Judicial Magistrate Ravi Kumar Gupta in response to a case brought before him by attorney Abhimanyu Singh, who claimed that online retailer Flipkart had sold him a fake/counterfeit Apple AirPods Pro (Bluetooth Headset) for the price of Rs. 17,489 in August.
In Singh’s case, he purchased an Apple Bluetooth headset on August 10, 2022, after seeing appealing advertising on the Flipkart website. He made an online payment of Rs. 17,489 in its place.
After that, a Flipkart delivery partner brought the item to him on August 12.
But after becoming skeptical of the product’s packaging and the written description on it, he went to an Apple-authorized repair centre, where he was informed that the item he had gotten from the firm was a fake since it had not been made by Apple.
On this basis, the complainant phoned a Flipkart customer service representative to inform them that the goods were fake and to request a refund.
On August 21, nevertheless, the company turned down his request for a refund.
Then, after making several unsuccessful attempts to file an FIR with the Lucknow Police, he filed the current application under Section 156(3) of the Code of Criminal Procedure before the Court of Chief Judicial Magistrate, Lucknow.
In his plea, he requested filing an FIR for the offence of cheating against Hydtel Retail Sales, Luminary Lifestyle Private Limited, Kalyan Krishnamurthy, the managing director of Flipkart, and the company’s vendors.
After taking note of his request, the Court ordered the Gomti Nagar Extension Police Station’s SHO to file a police report (FIR) against the accused for defrauding and misleading the complainant on October 10.
