The High Court of Karnataka has restrained the Police of Uttar Pradesh from taking action against Manish Maheshwari, the Managing Director of Twitter Communications India Private Ltd (TCIPL) in Ghaziabad FIR.
A notice under Section 41A of the Code of Criminal Procedure had been issued to him.
The Uttar Pradesh Police asked Manish Maheshwari to come to Loni Border police station for investigation purposes in relation to the Ghaziabad video issue.
Challenging the action taken by the police, Maheshwari filed a writ petition under Article 226 of the constitution of India. A single bench having Justice G Narender passed an interim order restricting the actions of the police.
“Prima facie the petitioner is apprehending deprivation of liberty”, the court said.
Senior Advocate Nagesh submitted on behalf of Twitter India MD that the petitioner is just a mere employee of TCIPL and had no role to play in circulating the video and he was not a member of the board of directors of the company and was only the revenue head looking after advertisement sales.
The High Court has asked the police that if they want to examine the petitioner then they should be doing it through virtual mode.
“There will be an interim order restraining the respondents from initiating any coercive action against the petitioner”, the bench stated in the order.
The case will be further heard on June 28.
