Kangana Ranaut moves Bombay HC for quashing Defamation Case by Javed Akhtar

Bollywood Actress Kangana Ranaut approached the Bombay High Court challenging the defamation case filed by lyricist Javed Akhtar.

Kangana Ranaut sought for quashing of criminal defamation proceedings initiated against her by the Metropolitan Magistrate at Andheri, Mumbai.

With the consequence of initiated cognizance in the matter, Kangana sought for revoking of entire proceedings including all the orders, summons issued till date.

The petition stated that the Magistrate is bound as per section 202 of the Code of Criminal Procedure (CrPC) to examine the complaint and the witnesses named in the complaint.

In the petition filed by Ranaut, she submitted that “The Magistrate did not use his powers to conduct an inquiry but instead blatantly used the police machinery to collect the signed witness statement, as and by way of inquiry conducted by a police officer, which is completely unheard of.”

The petition questioned upon declaration of witnesses and their statement collected by the Juhu police, not per the law.

Ranaut stated that in contravention to section 162 of the CrPC, the signed statements are collected illegally, which could not be admissible as substantive evidence.

Advocate Rizwan Siddiquee, appearing for Kangana Ranaut plead for urgent relief in criminal proceedings.

The matter is next to be heard on July 26.
