The Himachal Pradesh High Court issued Notices to the Chief Secretary, Principal Secretary (forest), State Pollution Control Board, Principal Chief Conservator of Forests, Kangra Deputy Commissioner, and Jwalamukhi Sub-divisional Magistrate in a case involving the installation of a Stone Crusher.
A Division Bench of Acting Chief Justice Ravi Malimath and Justice Jyotsna Rewal Dua passed these orders in a Public Interest Litigation alleging the installation of a Stone Crusher by Respondent Gian Chand in village Adhwani in violation of Pollution Control Board Regulations.
The Petition reads, “The Stone Crusher is being installed in violation of the Rules and its distance is less than 1km from a Government Senior Secondary School and less than 100 metres from the Water Reservoir.”
The Petition further reads, “The people have their homes nearby and also have cultivation land and grazing lands for cattle. Children and aged people also go the fields to rear cattle and do cultivation, and the dust and pollution will cause harm to everybody.”
The Petitioner prayed that the installation of the Stone Crusher be stopped immediately in order to preserve the villagers’ lives and health, as well as to prevent future generations from suffering the harmful effects of Environmental Degradation caused by the Stone Crusher.
Accordingly, the Court issued the Notice to the respondent, and posted the matter after two weeks.
