On Thursday, the Gujarat High Court stayed the Life Imprisonment sentence of ex- BJP MP Dinu Solanki who was accused of having connection with the murder of RTI activist Amit Jethwa.
Dinu was convicted in 2019 by a special CBI Court for killing the Activist in 2010 after the Activist had tried to expose illegal mining activities which was happening in the Gir Forest region.
A Bench comprising Justices Paresh Upadhyay and Ashok Kumar Joshi, observed that the Order of CBI Court was based on based on ‘assumptions and presumptions’ and that the verdict given was ‘prima facie erroneous’.
“In totality, this court finds that on facts the conviction recorded by the CBI court is prima facie, principally based on assumptions and presumptions and the same is unsustainable qua the applicant” ,stated the Court.
The Court also stated that his conviction was based on circumstantial evidence and it also noted that there are both the chances of may be and may not be proven guilty.
Adding to it, the Court also stated that the decision of Central Bureau of Investigation Court is unstainable and Court didn’t find any evidence.
The Court also observed that neither the Police nor the CID named Dinu as an accused but in year 2013, when the case was transferred to CBI, it named Dinu as a prime accused of planning the Criminal Conspiracy of Murder.
Hence, the Court considering the situation of false implication of the applicant, granted him Bail.
The case is all about Jethwa, a lawyer being killed for exposing illegal mining in and around the Gir Wildlife Sanctuary and Solanki through the RTI applications.
Solanki along with his cousin Shiva Solanki was convicted by a Court for Murder and Conspiracy.
