The Gauhati HC has ordered the Assam government to look into the matter of the petitioner seeking directions mandating the education of Patta holders.
The Bench of Chief Justice Rashmin Manharbhai Chhaya and Justice Soumitra Saikia was hearing the PIL matter seeking the relief, mandating the education/sensitisation of Patta holders to continue the holding of Patta land for the complete period of lease & directions for Patta holders to carry on such activites which generate earning or a means of enhancement of the Patta land.
The petitioners counsel submitted that petitioner has nothing to say against government however the incorrect report presented by the government have affected the rights of the Patta holders.
The Court stated that the petitioner has not been able to establish the fact that the same has affected the rights of any Patta holders or there is any complaint thereof. The petition is filed on general averments.
The bench fails to see the element of public interest even in the contentions raised before the Court orally.
The order directed by the Court reads as, “Still, however, we deem it fit to direct the State Government to look into the grievance of the petitioner as raised in this petition in accordance with law.”
Hence, the petition was disposed off by the High Court.
