Tahir Hussain, a former AAP councillor involved in the 2020 Northeast Delhi riots, has been granted bail in five related cases by the Delhi High Court. Justice Anish Dayal, presiding over a single-judge bench, issued the bail order for Hussain, who faces charges including rioting, mischief by fire, and criminal conspiracy. The high court imposed certain conditions for his release.
However, Hussain will remain in custody as he faces other cases, including the Delhi Police’s “larger conspiracy” case in which he has been booked under the stringent Unlawful Activities (Prevention) Act.
In October 2022, a Delhi court framed charges against Hussain, his brother Shah Alam, and four other individuals in one of the Northeast Delhi riots cases. The court noted that the mob had a clear objective to harm and kill Hindus.
Earlier, in February, senior advocate Salman Khurshid, representing Hussain, argued that his client had not been named in the initial witness statements, but his name appeared in subsequent statements. Khurshid highlighted that all co-accused in these cases had already been granted bail, leaving Hussain as the sole remaining individual in custody.
