The Delhi High Court quashed four First Information Reports (FIRs) registered by the Delhi Police in connection with a fire that occurred in Maujpur last year during the Delhi Riots.
The Court ruled that there could not be five separate FIRs registered for the same incident. In March 2020, the same accused was charged in five separate cases by the Police.
Justice Subramonium Prasad reiterated, “The law on the subject has been settled keeping in line with the principles enunciated by the Supreme Court of India. There can be no second FIR and no fresh investigation in respect of the same cognizable offence or the same occurrence giving rise to one or more cognizable offences.”
The primary FIR 106/2020 was registered in response to a complaint claiming arson in a house that was also set on fire during the riots.
However, the Court stated that any evidence discovered against the accused might be entered into the main FIR, FIR 106/2020.
The Court ruled, “All proceedings emanating therefrom are hereby quashed and set aside.”
