The Delhi High Court while hearing a Public Interest Litigation (PIL), issued notice against Google Pay as it had been alleged that its actions amounted to Unauthorised access and storage of user’s Aadhar as well as Banking information.
A Division Bench of Chief Justice DN Patel and Justice Jyoti Singh heard the plea filed by Abhijit Mishra, who claims that Google Pay has violated Article 21 of the Indian Constitution, Aadhar Act 2016, Banking Regulations Act, 1949 and Payments and Settlement Systems Act, 2007.
The petitioner’s Counsel argued that Google Pay has not been registered under the Payments and Settlement Act, 2007 in order to legally conduct the business of payments and transactions.
Likewise, the Reserve Bank of India (RBI) stated that Google Pay has not achieved the status of registered bank or co-operative bank under Banking Regulations Act, 1949.
However, the Unique Identification Authority of India (UIDAI) did not receive any application from Google Pay for the allowance of access, store or use of user’s Aadhar information.
The Authority did not receive any advice from RBI regarding the same.
