In a recent trademark infringement case, the Delhi High Court, presided over by Justice Prathiba M Singh, has granted an injunction against a Kerala-based furniture store, “Ikea Luxury Furniture,” restraining it from using the mark “IKEA” as a trademark or trade name on hoardings, stationery, banners, handbills, and promotional materials.
The legal action was initiated by multinational furniture company Inter IKEA Systems BV, seeking protection for its well-known mark ‘IKEA.‘
The court noted that the defendant furniture store was using the ‘IKEA’ mark for various furniture items, including inside hoardings in the shop and product boxes.
The court emphasized the status of the ‘IKEA’ mark as extremely well-known and owned by the Swedish company, the plaintiff.
Considering the defendant’s use of the mark for identical goods and products, targeting the same consumer segment, the court deemed it appropriate to grant an ex-parte ad-interim injunction in favor of Ikea.
Despite receiving a legal notice, the defendant failed to cease the use of the ‘IKEA’ mark. Consequently, the court ordered the defendant to be restrained from using the ‘IKEA’ mark or any other mark deceptively similar to it as a trademark or trade name on hoardings, store/shops, stationery, banners, handbills, and promotional materials.
Justice Singh also granted Ikea the authority to contact JustDial to take down the page of the defendant named ‘IKEA Luxury Furniture.’
