A Division Bench of Justice Siddharth Mridul and Justice Rajnish Bhatnagar allowed to hear Bail Plea of Umar Khalid on the daily basis from May 23, 2022 to complete it before vacations of the Court started.
The Trial Court denied Umar Khalid’s Bail Application in conspiracy of North East Delhi Riots Case.
The direction was made to by Justice Mukta Gupta and Justice Mini Pushkarna to list the Case before the Bench of Justice Mridul because as partly they heard matter.
The Justice Bhatnagar asked that can such words be used for Prime Minister?
Advocate representing accused said these words used in Amravati speech were metaphor. Justice Bhatnagar said, “Some other words could have been used for the Prime Minister.”
Justice Bhatnagar asked, “Your client (Umar Khalid) had said again and again that we will follow Mahatama Gandhi?”
Justice Mridul said, “You used the expression Inquilab and Krantikari. All of us know what it means. You used the expression Inquilab zindabad. That’s what we asked you.”
The Advocate pointed out that charges made under Charge-sheet alleged that Khalid was involved in terror activities.
The Justice Mridul termed the speech of Amravati was ‘obnoxious’ and said that peoples can criticise Government but be in ‘Lakshman Rekha’ and should not be crossed.
Four to five hours will be needed for argument informed by Special Public Prosecutor, Amit Prasad.
