The Delhi High Court has upheld, an Order of the Trial Court and also imposed reasonable conditions on the actress to ensure her return back in this country.
Further ensured her joining for further investigation, only then the Court permitted Bollywood actress Jacqueline Fernandez to travel to the United Arab Emirates (UAE) and attend International Indian Film Academy (IIFA) awards.
However, Justice Sudhir Kumar Jain modified the condition in the Order of Trial Court to the extent that the actress shall submit an FDR of Rs. 1 Crore from Rs. 50 Lacs in the order of Trial Court, along with an undertaking that that in case she does not come back, the money will be forfeited by the Enforcement Directorate (ED).
The respondent is stated to be residing in this country since 2009 and is a Bollywood actress.
The respondent is going to Abu Dhabi, UAE for 6 days with effect from 31.05.2022 to 05.06.2022 for IIFA Awards events.
The respondent has joined the investigation as and when required by the Investigating Agency ED and cooperated. The Petitioner has already filed the charge sheet against the other accused but the investigation in respect of the respondent is still pending.
The respondent on earlier occasion also sought permission to go abroad and her request was not responded by the petitioner and would be willing to abide by any condition that the court may impose.’ the Court noted at the outset.
“The impugned order dated 28.05.2022 does not call for any interference. However, it is made that the respondent shall not interfere or tamper with case in any manner with the evidence or investigation of the present ECIR,” the High Court said.
Being an actor, she was invited for events, press conferences and rehearsals, the plea stated. Fernandez, therefore, sought to travel to Abu Dhabi, UAE for the IIFA awards. She also sought to travel to France for the Cannes Film Festival, as well as a show in Nepal.
The ED, however, said that Fernandez is a Sri Lankan National who was in receipt of proceeds of crime in Sukesh Chandrashekhar case and there is an apprehension that she may not return to India.
