The Delhi High Court has ordered the Central Government to decide on the issue of creating a separate complex for the National Company Law Tribunal (NCLT) and National Company Law Appellate Tribunal (NCLAT) within eight weeks.

The ruling was issued by a division bench consisting of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad in response to petitions that the bar associations for the two tribunals submitted in 2018 complaining about a number of shortcomings in the current facilities.

The petitioners’ counsel stated in court on October 19 that the Bar has been given a list of possible plots and other buildings that are now under development in order to form a complex to house the two tribunals.

Senior Panel counsel Bharathi Raju, representing the Centre, requested that the list be given to her so that she could give it to the appropriate authorities so they could make a decision.

“Let the same may be done. After receiving the aforesaid list, the Respondents are directed to positively take a decision within eight weeks from today,” the court ordered.

The court also ordered the Centre to take into consideration allocating the entire floor of the building, where the NCLT is now working from, to the tribunal, noting that space is now available, after reading the status report filed in the issue.

“The Respondents shall also comply with the undertakings given by them in the Status Report,” the court said.

The hearing is now scheduled for February 3, 2023.

The Ministry of New and Renewable Energy vacated a space in the building where the NCLT is housed, and the court ordered in April that the space not be occupied, renovated, or built in.
