The Delhi High Court has issued a new nomenclature for proceedings pertaining to Intellectual Property Rights (IPR), which would take effect immediately.
The Intellectual Property Division (IPD) was recently established by the High Court to handle all disputes concerning Intellectual Property Rights (IPR). Original proceedings, Writ Petitions (Civil), CMM, RFA, and FAO on Intellectual Property Rights disputes are handled by the IP, with the exception of those that must be handled by the Division Bench.
The existing Writ Petition in the Court nomenclature will be replaced by WP (C)-IPD, according to an official order issued by the Registrar General on Wednesday.
Similarly, for IPR-related proceedings, Civil Misc. (Main) will be replaced with Civil Misc. (Main)-IPD.
The IPDs were formed based on the suggestions of Chief Justice D.N. Patel’s committee, which included Hon’ble Ms. Justice Prathiba M. Singh and Hon’ble Mr. Justice Sanjeev Narula.
The committee was formed to streamline and analyse how a large number of IPR cases should be handled. Its report on IPR and non-IPR subjects have been presented.
Previously, the Intellectual Property Appellate Board (IPAB) dealt with appeals from IP offices and problems such as revocation of Trade Marks, Patents, and other intellectual property-related statutes.
The Tribunals Reforms (Rationalisation and Conditions of Service) Ordinance, 2021, dissolved the IPAB while it had a ‘significant pendency.’
