The Delhi High Court dismissed a public interest litigation (PIL) that contested the nomination of the recently sworn-in Chief Justice of India, DY Chandrachud, and assessed the petitioner a cost of Rs. 1 lakh.
It was referred to as a “publicity interest litigation” by a division bench consisting of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad.
Sanjeev Kumar Tiwari, who filed the PIL, said that Justice Chandrachud’s appointment went against the spirit of the constitution. He sought Justice Chandrachud appointment to be stayed immediately.
In the PIL, Tiwari, who identified himself as “a well-educated intelligent common citizen of the nation of India,” demanded that the security forces must investigate the new CJI to make sure he “does not have any form of link with the anti-nationals and Naxalite Christian terrorists.”
Along with it, he asserted that Justice Chandrachud “would be aware in defeating the traitors who are plotting to assassinate the Prime Minister.” Lawyers like Prashant Bhushan and Indira Jaising, according to the PIL, want the Chief Justice to be “their accomplice.”
On Wednesday, Justice Chandrachud took his oath to become the CJI.
