A Court in Delhi recently convicted three men who were accused of outraging modesty of a woman bouncer in a club.
The women bouncer’s testimony was of sterling quality and the “Shock and horror of the brazen manner in which she was molested and assaulted by the accused persons was heavily bearing on the mind but ultimately truth prevails,” observed the Court.
Principal District & Sessions Judge of Tis Hazari Courts, Dharmesh Sharma observed that the prosecution was able to prove the allegations against the accused, and the accused are punishable under Section 452 read with Section 34 of Indian Penal Code
“As the nature of injuries inflicted upon the victims / injured persons was by all means ‘simple’ in nature, the offence under Section 323 IPC was also committed by the accused persons in furtherance of their common intention and in the process or same transaction PW-1 was also molested as not only accused Gautam Gambhir and Nitin Nayyar @ Sunny fiddled with her breast and attempted to kiss her but also hit her on her private part. It was a clear case of outraging modesty of a woman punishable under Section 354 IPC,” the Court stated.
The shocking incident took place on July 15, 2016 at the Hammer Club in West Delhi.
Allegedly, the convicts Gautam Gambhir, Mohit and Nitin Nayyar had attacked the bouncer and her two colleagues at the club with swords, sticks and iron pipes. It later resulted in rivalry between the two groups.
