Speaking at a Felicitation Function, Chief Justice of India (CJI) NV Ramana said that the Judges have no objection to the opening of the Courts and expressed hope that the Physical hearings in the Courts would resume after Dussehra.
The CJI stated, “I have no issue, even during the pandemic time I was ready. The majority of Advocates do not prefer Physical Courts, for whatever reason. Senior Counsels have some reservations, but youngsters and other Advocates are willing to come.”
Justice Ramana further said that the President of the Supreme Court Bar Association, Vikas Singh, assured him that the Standard Operating Procedure (SOP) has some flaws in it and that it will be liberalized soon.
Importantly, regarding the full opening of Courts, the CJI said, “We hope that there are no more waves, and shortly, after most probably Post-Dussehra vacations, we can go for the Physical hearing.”
A Bench of CJI Ramana, Justice Nageswara Rao, and Justice Surya Kant expressed dissatisfaction at Advocates turning up to Court for Physical hearings in fewer numbers after the resumption of Physical hearings in the Supreme Court with the hybrid option from September 1, 2021.
The Bench further indicated that once the Advocates begin to appear in Court for hearings, the concerns with the SOP would be resolved.
