The Calcutta High Court sought responses from the State Government and the Union of India in a batch of Petitions filed by the Legal Heirs of those who died as a result of alleged Central Industrial Security Force Personnel firing on April 10, 2021, at Sitalkuchi in Cooch Behar District during the West Bengal Assembly Elections.
According to the Petitions, the event was caused by Police gunfire during electioneering. As a result, an independent Investigation of the incident was requested. As a result, the Case was handed over to West Bengal’s Criminal Investigation Department.
A Bench comprised of Chief Justice Prakash Shrivastava and Justice Rajarshi Bharadwaj was informed that the Victims’ families have filed Petitions seeking different Reliefs, including compensation from the State, about the occurrence.
While hearing a batch of Public Interest Litigation Petitions about the event, the Court previously took the Interim status Report issued by West Bengal’s Criminal Inquiry Department on the ongoing Investigation into account.
The Lawyer for one of the Victims’ family members argued before the Court that the family members should be reimbursed by the State because the Victims were young and the sole breadwinners for their families.
Taking note of the Complaint, the Court instructed the State Administration and the Union of India to file their Affidavits-in-Opposition within four weeks. The Petitioners were asked to respond within one week.
