The Bombay High Court has observed that a disclosure statement by a co-accused under Section 27 of the Indian Evidence Act is not legal evidence.
The bench consisting of Justice Nijamoddin Jahiroddin Jamadar made the aforesaid observation while granting bail to an offender charged under Section 307 of the IPC.
The court stated that there was proof to show that the first informant and his driver were injured. However, the court stated that the injuries were minor in nature.
The arguments given by the applicant were justified, and the disclosure statement made by the co-accused under Section 27 of the evidence act is not legal evidence.
The court granted bail to the applicant.
