In a 2020 porn video case, the Bombay High Court on Thursday denied the Anticipatory Bail motions of six people, including Raj Kundra, Sherlyn Chopra, and Poonam Pandey.
However, Justice Nitin Sambre gave the Accused four weeks to file a petition with the Supreme Court.
Suvojit Chaudhari, Umesh Kamat, and Sam Ahmad are the other three Defendants whose Anticipatory Bail applications were denied.
The Defendants were Arrested after a retired Customs and Central Excise official, Madhukar Keni, 67, filed a complaint.
On October 31, 2020, he approached the Cyber Police with a pen drive and a complaint against various pornographic content platforms. When Sherlyn Chopra’s name was typed into a search engine, he claimed, her lewd films appeared on the screen.
Chopra is a director in two firms and also develops content for the website of another adult broadcasting company, according to her plea. According to a New York Times article, the website has entrusted adult entertainment to its entertainers or sex workers. ‘Call it the pornographic paywall,’ the Petition added.
Chopra claims in her application that the freely available porn site content alluded to in the FIR is all pirated, a copyright Violation. She is merely a source of content for the original platform.
Chopra and Pandey were under temporary protection the entire time.
AAP Rujuta Ambekar contended that while Kundra may have been given Bail in the previous obscenity case, there were several other Defendants whose roles were clearly identified in this case.
Raj Kundra’s name is not listed in the FIR filed last year, according to his lawyers and he cooperated throughout the investigation.
Kundra also stated that one of the company’s apps, ‘Hotshots,’ had nothing to do with pornography, as the Police claim.
Kundra also claimed that he was wrongfully Accused and dragged into the case. In another case involving obscenity, Kundra was just granted Anticipatory Bail.
