The complaint was filed by Medha Somaiya who is also a wife of Bharatiya Janata Party Leader Kirit Somaiya in a Civil Suit for a Defamatory Article published in ‘SAAMNA’ Newspaper against Sanjay Raut who is Shiv Sena Leader and Rajya Sabha member in Bombay High Court.
Raut was Editor-in-Chief of Saamna newspaper.
The article accused Samaiya of building unauthorised toilets by cutting mangrove trees without taking permission from environment department. This tender includes 100 Crore Rupees.
The article was taken from other electronic and print media.
“The impression sought to be created by these Defendants (Raut) in the mind of the public at large that the plaintiff has committed Toilet Scam of Rs. 100 crores. …these Defendants have denigrated, tarnished image of the Plaintiff in the eyes of the general public, etc. …such imputation which by itself harms her reputation is per-se defamatory and actionable,” the Plaint said.
The Article accused Somaiya of committing a scam of 100 Crore Rupees, siphoned public money, swindle money on manipulation of building toilets and termed her Non-Governmental Organization ‘Yuva Pratisthan’ fake and fraud.
She sent letter to Raut through an Advocate asking for unconditional apology then she wrote a letter to Senior Inspector of Police for registering First Information Report (FIR) against Raut.
But no FIR was lodged so she filed a compliant in the Court of Metropolitan Magistrate at Mazgaon for Criminal Proceeding
Then she went to Bombay High Court to get damages of 100 Crore Rupees separately.
The reliefs asked by her are:
- To deposit 100 Crore Rupees in CM Relief Fund.
- Unqualified apology should be published by Raut in front page of newspaper.
- Permanent Injunction against publishing this Defamatory Article again.
