Amazon moves SC challenging Delhi HC stay order restraining future retail deal with Reliance

Amazon has filed a petition in the Supreme Court challenging a stay order issued by Delhi High Court on March 22, that stayed a single-judge order ordering the attachment of Future Group companies and Kishore Biyani’s assets.

The Supreme Court of India will now hear the case between Amazon and Future Retail. After Amazon filed an appeal with the Supreme Court, Future Retail said it would “defend the matter/proceedings through legal counsels”.

The Future Retail informed the stock exchange stating,

‘‘The company’s advocates are in receipt of the communication dated April 13, 2021, from advocates of Amazon.com NV Investment Holdings LLC informing that Amazon has filed a Special Leave Petition before the Supreme Court of India against the captioned order dated March 22, 2021, passed by the Division Bench of the High Court of Delhi,’’

On March 22, the Delhi High Court bench lifted the stay over Future’s Rs 24,713 crore contract with Mukesh Ambani’s retail firm.

In its most recent Supreme Court filing, Amazon claimed that the HC order was “random,” “illegal,” “inequitable,” and “unfair,” and that the HC order should be ban until the results of its earlier case-related filing.

Amazon in its High Court filing stated that the Kishore Biyani-led company breached the terms of its contract with Amazon by signing the RIL agreement. The case has been rescheduled for a hearing on April 30.

Prior to that, on March 18, Justice JR Midha issued a judgment against Future, stating that the company wilfully disobeyed the Singapore Arbitrator’s order and ordered it not to take any further action on the contract.

The Court also demanded that they prove the reason why they shouldn’t be held in civil jail for three months for violating the emergency arbitrator’s order. Future Group and its directors had a fine of Rs 20 lakh imposed.
