Hearing a case of Bail plea, a single judge bench of Justice Ajay Bhanot has directed the Director General of Police; UP to ensure a time bound procedure for supplying instructions to government advocates and additional government advocates.
The direction to establish such procedure within the period of 8 weeks comes after a bail plea could not heard because of the failure of authorities in giving instructions to AGA with no explanation of such failure.
Observing the seriousness of the issue, the Court observed that it is the right of an accused to have his bail application heard within a reasonable time.
The Court further ordered that there has to be a constant oversight of the implementation of such procedure and appropriate departmental action as per law should be taken against officials who without good cause fail to discharge their assigned duties.
The State has assured the Court that an enquiry has been ordered against the official responsible for such failure.
