The Allahabad High Court ruled that the Nursery Training Certificate does not hold equivalence to the Basic Teachers Training Certificate required for the position of Assistant Teachers for Classes I to V.
The Court dismissed a set of petitions challenging the non-appointment of individuals as Assistant Teachers on the grounds of lacking essential qualifications.
The State contested the interim order directing result declaration, and the Appellate Court upheld it.
Justice Saurabh Shyam Shamshery, presiding over the case, remarked that a simple examination of the course materials of Certificate Training (Shishu Shiksha) and Basic Teacher Certificate revealed that the latter is designed for teaching purposes up to Class-V, while the former is limited to preschool education, up to class-II only.
The petitioners, who held a Nursery Training Certificate issued in 2013 by the Examination Regulatory Authority and cleared the Uttar Pradesh Teachers Eligibility Test in the same year, were denied appointments as Assistant Teachers. The reason cited was their alleged failure to possess the essential qualification of completing a two-year BTC Course or Special BTC Course, as mandated by the October 17, 2013 notification/advertisement.
The Court framed the central issue: “Whether Nursery Training Certificate is equivalent to Diploma in Elementary Education and subsequent notification and whether it is also equivalent to Basic Teachers Training Certificate for the purpose of the minimum qualification for the post of Assistant Teacher in primary school (class I to V) run by Basic Education Board?”
While the petitioners argued that the minimum qualification prescribed by the National Council for Teachers Education should prevail, the Court emphasized the lack of details regarding the study material/syllabus of the referred examination.
Upon scrutinizing the course materials, the Court determined that the Certificate Training (Shishu Shiksha) does not meet the minimum qualification of BTC required for the appointment of Assistant Teachers.
