The High Court of Allahabad has recently granted 3 people accused of raising slogans against the Uttar Pradesh Chief Minister and burning his effigy bail.
The charges framed upon the 3 accused were for sedition.
The accused contended they participated in a political protest and therefore it cannot be an offence under Section 124A of the Indian Penal Code (Punishment for sedition).
The single bench of Justice Suneet Kumar granted the 3 accused namely Phoolchandra Yadav, Aashutosh Agrahari and Suraj Singh and directed them to furnish their personal bonds with two sureties each in the like amount to the satisfaction of the Court.
The prosecution reportedly said that there were 12 nominated and 10-12 unknown people who had raised hatred slogans against the Chief Minister. The F.I.R had the name of the known applicants, the counsel said that the co-accused with similar circumstances their bail have been extended.
The prosecution further submitted that the applicants are in jail since 17.03.2021 and there is no slight chance of early disposal of trial and if they are granted bail they will never misuse their liberty and will cooperate with the procedures of trial.
The Court with its prima facie satisfaction, with due consideration of the nature of accusation and the punishment in case of conviction and without expressing its opinion on the merits of the case granted bail to the accused.
