Allahabad HC refuses to entertain PIL alleging corruption in Madarsas, says Prayers omnibus in nature

The Allahabad High Court on January 04, declined to entertain a Public Interest Litigation (PIL) filed by a farmer, alleging Corruption in the appointment of teaching and non-teaching staff of certain Madarsas.

The Bench of Justice Devendra Kumar Upadhyaya and Justice Subhash Vidyarthi, on perusal of the prayers of the PIL stated that the prayers were omnibus in nature.

Apparently, the Petitioner sought directions be issued to the officers to carry out their lawful duties with honesty. The Court observed that the prayers were vaguely worded and not specific in nature. Regarding the documents annexed, the Court was of the opinion that they were inadequate and insufficient to throw any light on the nature of alleged Corruption in the Madarsas.

Due to the omnibus and vague nature of the prayers made, the Court refused to entertain the PIL. Although, the Court gave the liberty to persuade the appropriate Authority regarding this matter.

The Court also gave the liberty to the Petitioner to bring to its notice specific instances of Corruption in regards to the illegal appointments and siphoning of the funds.

The Petitioner was also told to apprise the Director General of the Economic Offences Wing in case he is Aggrieved from the delayed investigation of the 2012 FIR registered under Sections 406, 409, 419, 420, 467, 468, 471, 120-B I.P.C. On any such Application made to the Director General, he shall take appropriate decision thereon, with the expedition.
