Recently, Allahabad High Court denied Bail to the lone Accused in connection with the journalist Vikram Joshi’s Murder Case.
In July 2020, a CCTV footage showed Vikram Joshi riding on a two-wheeler with his two daughters aged 5 and 11 when he was stopped and assaulted by a group of men.
Thereafter, he was shot by the Accused and succumbed to his injury the next day.
The Counsel for the Accused pointed out that the case against the applicant was entirely based on the Confessional Statements of the other Accused persons and the recovery of a country-made pistol from his possession.
Since all the other Co-Accused were granted Bail, the applicant should too. The Counsel also urged that he had no Mens Rea or motive to commit the Murder.
To this, the State argued that since all the Chargesheets attributed the role of firing solely to the applicant along with the fact that the pistol was recovered from his possession, draws up a conclusion that he was solely responsible for the Murder of Vikram Joshi.
Taking into account all the submissions made, the Court ordered, “All these facts cumulatively joined involvement of the applicant alone in committing the brutal murder of the deceased journalist cannot be ruled out and thus Bail of the applicant stands REJECTED”
The Court also directed the Trial Court to conclude the Trial expeditiously.
