The Allahabad High Court decided to consider a bunch of questions on the issues related to religious educational institutions like Madrasa on their role and the interplay between the State Government and such institutions within the ambit of the Constitution.

The Single Judge Bench of Justice Ajay Bhanot was dealing with a petition filed by a Madrasa which is duly recognized by the Madras Board and is aided by the State Government.

The State Government denied the application for the formation of additional posts for teachers with respect to the increasing number of students.

The plea contended against the decision of the State Government of rejecting such an application.

Before proceeding with the matter, the Court sought a response from the State Government on the availability of playgrounds at the Madrasas and all other religious institutions which were aided by the State Government and also directed to submit records of courses, conditions, and standards of recognition in the religious institutions.

Further, the Court directed the State Government to disclose as to whether Madrasas so recognized and aided also admit girl students.

The Court has ordered the State Government to file counter-affidavits in four weeks.
