Allahabad High Court held that two adults have all the rights to choose their Matrimonial Partner no matter what Religion they profess.
Further, the Court held that even their parents can’t object to the relationship if both the partners are adults.
The Court stated, “It cannot be disputed that two adults have right of choice of their matrimonial partner irrespective of religious professed by them….As the present petition is a joint petition by the two individuals who claims to be in love with each other and are major, therefore, in our considered opinion, nobody, not even their parents, could object to their relationship.”
A Division Bench comprising Justices Manoj Kumar Gupta and Deepak Verma passed this order while they were dealing with a Joint Petition filed by Shifa Hasan and her partner, who is a Hindu.
In their Petition, they claimed to be in love and wanted to stay together but their respective families were creating disturbance for the Couple.
The Court granted them protection stating that they both are in love, want to stay together and are major. Therefore, no one can objectify their relationship.
Granting them protection, the Court also directed the State Authorities to ensure their safety.
The Court further ordered the State Authorities to make sure that no one harasses or disturbs the couple.
The Court also took note of the couple being a Major Couple.
Shifa, the Muslim girl is 19 years and the boy, the Hindu partner is aged 24 years.
Lastly, the Court observed that this is not the final order regarding the age of the couple but at the time being they need protection as there is a threat to their lives.
