Advise to suspended Judge: Face the probe, come clean

The High Court of Telangana has advised a suspended Additional District Judge, who was arrested in a disproportionate assets case, to face the investigation & prove his innocence in lieu of asking the court to revoke the ACB FIR against him.

“Face the probe. Come clean. That is good for the judiciary as an institution,” said a bench of Chief Justice Hima Kohli & Justice B Vijaysen Reddy. This was said by the judges while dealing with a writ petition filed by V Vara Prasad, an Additional District Judge from Rangareddy district court.

Prasad was placed under suspension by the HC after the ACB was granted permission from then acting CJ of the HC to proceed against him & arrested him in Nov 2018.

Prasad sought quashing of the case, describing the action of the ACB as without any basis. Regardless, the Judges felt that the petitioner brewed hundreds of grounds in support of his claims which cannot be examined in writ jurisdiction.

The petitioner’s counsel sought permission from the court to withdraw his plea, being aware of the direction of the court’s proceeding.The Judges permitted him while advising him to face the probe.
