Daughter-in-Law Now also Eligible for Allotment of Fair Price Shop on Compassionate Grounds: Allahabad HC

The Allahabad High Court recently Ruled Out that Daughter-In-Law is now also Entitled to the Allotment of the Fair Price Shop on Compassionate Grounds.

In this particular Case Sharma Devi had filed an Application for Allotment of Fair Price shop on the Grounds of Compassion but the Government Rejected it saying she does not come under the term of Family as mentioned in Paragraph IV (10) of Government Order dated 05 August, 2019.

The Court said that even though a Daughter-In-Law is not covered under the definition of the term Family as mentioned in the said Government Order such an Exclusion has been ruled to be Ultra Vires to the Indian Constitution in terms of the Court’s Judgement in Uttar Pradesh Power Corporation Limited Vs. Smt. Urmila Devi.

Hence, the Court Quashed the Impugned Order and directed the Respondent Government Authority to consider the Petitioner’s application for Allotment Expeditiously, preferably within Six Weeks.
