Jharkhand has now become the fifth state to withdraw the general consent granted to the Central Bureau of Investigation (CBI) for disallowing the probe agency to investigate cases in the state.
After Kerala, Maharashtra, West Bengal, and Rajasthan – Jharkhand led by the Jharkhand Mukti Morcha has revoked the general consent.
The Delhi Special Police Establishment (DSPE) Act 1946 empowers the union government to allow CBI to conduct probe in any state, provided there is general consent. In some cases, the CBI can also ask the state government for investigation. The Act, unlike the National Investigation Act (NIA) Act, needs the consent of the state government to permit the CBI for any investigation in the respective state.
