The Supreme Court of India permitted the students, who has qualified the exam of JEE-Main in their third attempt to make representation before the competent authority of the Joint Admission Board, JEE-Advance.
The Bench comprising Justice AM Khanwilkar, Justice Dinesh Maheshwari and Justice CT Ravikumar disposed the Writ Petition filed by qualifiers of JEE-Main in their third attempt, seeking accommodation to appear for JEE-Advance Exam 2021, observing that it cannot interfere with a Policy decision taken by the Examination Authorities.
However, the Court allowed the petitioners to make a representation before the competent authority.
“Ineligibility prescribed in criterion 4 of clause 11 in the JEE-Advanced, 2020 Information Brochure insofar as it renders candidates who cleared class XII in 2019 ineligible from being able to sit for JEE-Advanced even after qualifying JEE Mains should be declared arbitrary and violative of Article 14,” the petition stated.
The Court then directed the concerned authority to take a decision on the request made by this category of students, to whether they should be allowed to attend the exam of JEE-Advance 2021 or not.
“If there is some way forward, you may consider it. You can reconsider your policy,” the Bench said to the respondents.
Advocate on Record (AOR) Sumanth Nookala, representing the petitioners submitted that, the petitioners who has completed their Class XII in 2019 are exempted for giving exam of JEE-Advance, although they are within the prescribed age limit mentioned in the information brochure.
The Petitioners have also added a Right to Information (RTI) reply in their petition, which stated that nearly 12,000 students will be excused to appear for JEE-Advance exam due to this particular condition mentioned in their brochure.
The counsel for the JEE authority in their submission cited the case of Jajati Panda and Others v. Union of India, 2020, in which the Apex Court refused to entertain a petition upon similar matter.
