Bombay High Court: No mask, no hearing, penalises lawyer

Bombay High Court called off a case hearing after seeing that a counsel for the appellant had taken off his face mask.

A single Judge Bench of Justice Prithviraj Chavan was hearing an appeal when the appellant’s advocate removed his mask in violation of guidelines of Standard Operating Procedures (SOPs) laid down by the High Court at the time of resumption of physical hearing of cases.

The SOPs contemplates wearing of the mask at all times, even during arguments in court’’ is mandatory


The SOP also requires strict compliance of social distancing and says entry to courtrooms for physical hearing stands restricted to: one advocate per party whose vakalatnama is on record or who has been duly authorized and whose case is listed for hearing on board of concerned court.’’
