The Supreme Court asked Jharkhand CM, Hemant Soren, to submit a copy of the writ petition to the HC which called for an independent probe against him for allegedly laundering money through shell companies.
The Bench comprising Justices UU Lalit and S Ravindra Bhat while hearing petitions of State of Jharkhand and Hemant Soren challenging the High court order which accepted the maintainability of the said plea.
Senior advocate, Kapil Sibal, informed the court that the HC proceeded to pass the orders even though the PILs were not genuine and politically motivated.
A vacation bench of Justice DY Chandrachud and Justice Bela M Trivedi challenged the decision to accept the documents submitted by the Enforcement Directorate.
The bench hearing the plea has directed, “That the issue as to maintainability should be dealt with by the High Court on the next date of listing.”
“Based on the outcome of the objections to the maintainability of the proceedings, the High Court may thereafter proceed in accordance with the law.”
