A Special PMLA Court rejected a plea of man who wanted Advocate Satish Uke, arrested in case of money laundering, as his lawyer and to continue to represent him in his plea filed in the Bombay High Court.
Special Judge M.G. Deshpande rejected the application observing that, “Once any person is arrestedand further remanded to judicial custody, there is complete legal restraint on his professional activities.”
The applicant Suresh Hedau’s election petition matter is in its final stage before the Nagpur Bench of Bombay High Court. According to him lawyer, Mr. Satish Uke was arrested and taken to Mumbai by the Enforcement Directorate on 31st March 2022.
He further alleged that Uke’s arrest was illegally done by ED, as he was taken from Nagpur to Mumbai without any transit remand and purposely was not presented before Magistrate within 24 hrs.
In his plea, Hadau said that a day later his matter was listed before the High Court & since Uke was absent, it was adjourned for next 4 weeks. Further, no lawyer was ready to take his brief.
The Special Judge MG Deshpande stated that, “..Various allegations relating to his (Uke’s) arrest and production before this court by the ED were already dealt with vide the concerned proceedings. There is nothing before the court to indicate that Mr. Uke has challenged the same before the…High Court.”
The Court concluded that, “In this background, first part of the contentions in this application regarding illegality in the arrest of Mr. Uke made by the applicant is without any locus and the same is baseless.”
