Mumbai Court allows undertrial to shift prison, says ‘Right to meet Kin’

Special Court in Mumbai allowed an undertrial to be shifted from Mumbai Central Prison to Taloja Central Prison. This was done to protect the right of an undertrial to meet his family, friends, and legal advisors.

The Plea was made by Haroon Naik, who is an undertrial in the Mumbai triple Blast of July 13, 2011. In his Plea, he told the Court that the Mumbai Central Prison was very far from his home and usually takes the whole day of travel for his family to visit him, costing them a day’s expense at work and also preventing them from visiting him regularly.

Naik while referring to a Supreme Court’s judgement stated that a distant Prison was adversely affecting his Right to defend himself and at the same time caused isolation from his family, relatives and friends.

While allowing Naik’s Plea, the Special Court said, “The applicant has been facing custody for last 8 years, during which on very few occasions he had to meet his family members due to his long-distance stay at Mumbai Central Prison .. his trial will take time further”

On July 13, 2011, there was a triple Blast at Zaveri Bazaar, Opera House, and Dadar which led to the Death of 27 and 137 being Injured. In January 2012 Naik Naqi Ahmed, Nadeem Akhtar, and Kanwarnain Pathreja were Arrested for allegedly being co-conspirators of this triple Blast. The Trial, in this case, is yet to commence after the Court framed charges against the Accused.
