Stating that the movie Violates the Right to Privacy, a PIL has been moved in Kerala High Court requesting to ban the release of the movie Kurup.
The PIL sought to ban the release of a movie starring Dulquer Salman which is based on the life of Sukumaran Kurup, a proclaimed Offender.
The Petitioner claimed that the movie Violates the privacy of Sukumaran and asked the Court to direct the Respondents to Bar the release.
“The drama will revolve around his legendary Crime and how his escape became a pop-culture phenomenon,” stated the Plea.
In the Plea, the Petitioner has contended that because of being a proclaimed Offender, Sukumaran can’t move to Court to safeguard his Rights, and thus, it is an exploitation of his Rights.
“Publication of a movie on the life of a proclaimed Offender has to be presented as it is a clear Violation of the Fundamental Rights of the underprivileged section of the State. The infringement over the Right to privacy of the proclaimed Offenders have to be prevented,” stated the Plea.
The Petitioner has also argued that it is the duty of the Centre to protect the Rights of Kurup under Articles 20 and 21 of the Indian Constitution as he is a Citizen of India.
The Plea also stated that Kurup belongs to those underprivileged sections of society, whose Rights are not safeguarded.
“The Court is under an obligation to maintain a balance between all the stakeholder and safeguard the interests of the Victim, Accused, Society and the State,” added the Plea.
On Tuesday, a Division Bench comprising Chief Justice S. Manikumar and Justice Shaji P. Chaly accepted the Plea.
The Bench also issued a Notice to the Respondents to file the reply in the Matter.
